The European Parliament has called on the European Commission to establish new rules governing the use of algorithmic management systems in the workplace. The legislative initiative report was adopted with 451 votes in favor, 45 against and 153 abstentions.

The report stresses that algorithmic management systems must operate under human supervision. It proposes that employees should have the right to be informed about decisions made by algorithms and to request a review when necessary. Decisions on recruitment, dismissal, contract renewals, pay changes and disciplinary sanctions are requested to be taken solely by humans.

The report also foresees a ban on processing data related to employees’ emotional, psychological or neurological conditions, their private communications, location data outside working hours and trade union activities, in order to protect data privacy.

EP rapporteur Andrzej Buła noted that the regulation concerns both employers and 200 million workers in the EU, highlighting the importance of a human-centered approach.

Following the adoption of the legislative initiative report, it was reported that the European Commission will respond to Parliament’s request within three months or explain its reasons.

It was also noted that under existing EU legislation, the use of artificial intelligence in the workplace is regulated by the AI Act, the GDPR and the Platform Work Directive.
